Wayfarers of the Void Effective date: [to be set at launch]

These Terms are an agreement between you and COGTIDE LLC ("we", "us") covering your use of the game Wayfarers of the Void and its related services (the "Game"). By playing the Game or creating an account, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Game.

1. Who can play

You must be at least 13 years old to create an account. If you're under the age of majority where you live, you may only use the Game with the permission of a parent or guardian, who agrees to these Terms on your behalf.

2. Your account

Accounts are optional; the campaign can be played as a guest. If you create one:

• Give accurate information and keep your sign-in details secure. You're responsible for activity on your account.
• One person per account. Don't share, sell or transfer accounts.
• Tell us at contact@cogtide.com if you think your account has been compromised.

You can delete your account at any time in the Game. Deletion is permanent and can't be undone.

3. Your license to play

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and play the Game for your own non-commercial entertainment, on devices you own or control, subject to these Terms and to the rules of the app store you got it from. We, and our licensors, own the Game and everything in it, including its code, art, music, story, characters and in-game items. These Terms don't transfer any of that to you.

4. In-game currency and items

The Game may include virtual currency (such as Aurics) and virtual items, earned through play or bought with real money through the App Store or Google Play.

• Virtual currency and items are a limited license to use within the Game. They have no real-world value, aren't your property, and can't be redeemed for money or anything of value outside the Game.
• They can't be transferred, sold or traded, inside or outside the Game.
• Purchases are processed by Apple or Google under their terms. Except where the law or the app store's policy requires otherwise, all purchases are final and non-refundable.
• If your account is deleted, by you or by us under section 7, any virtual currency and items on it are forfeited.
• We may change, rebalance or discontinue virtual currency and items as the Game evolves. If we discontinue the Game, we'll give reasonable advance notice in the Game.

5. Rules of conduct

Don't:

• cheat, exploit bugs, or use bots, mods or other unauthorised software to gain an advantage
• tamper with, reverse-engineer or interfere with the Game, its servers or other players' use of it, except where the law expressly allows
• access or attempt to access accounts or systems that aren't yours
• use the Game for anything unlawful

6. Changes and availability

The Game is a live, evolving product. We may update, change, suspend or discontinue all or part of it, including content, features and balance, at any time. Some features need an internet connection and may sometimes be unavailable.

7. Suspension and termination

We may suspend or terminate your account or access to the Game if you break these Terms, if required by law, or to protect the Game or other players. Where reasonable, we'll tell you why. You may stop using the Game and delete your account at any time.

8. Disclaimers

The Game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't promise the Game will be uninterrupted, error-free or that saves will never be lost.

9. Limitation of liability

To the fullest extent the law allows, COGTIDE LLC won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Game. Our total liability for any claim relating to the Game is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50. Some places don't allow these limits, so they may not fully apply to you.

10. Governing law

These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in South Carolina, and you and we consent to their jurisdiction. Nothing here limits rights you have under the consumer-protection laws of the place where you live.

11. App store terms

If you got the Game from the Apple App Store:

• These Terms are between you and COGTIDE LLC only, not Apple. Apple isn't responsible for the Game or its content.
• Apple has no obligation to provide maintenance or support for the Game.
• If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation.
• Apple isn't responsible for addressing any claims relating to the Game, including product liability, legal or regulatory compliance, or consumer-protection claims, or for any third-party claim that the Game infringes someone's intellectual property. We are, to the extent these Terms require.
• You confirm you're not located in a country subject to a US government embargo, and aren't on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you got the Game from Google Play, Google's terms for purchases also apply.

12. Changes to these Terms

We may update these Terms. If a change is significant, we'll tell you in the Game before it takes effect. Continuing to play after it takes effect means you accept the updated Terms.
